RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT
(For Adults and Minors) Effective in the State of Texas
WARNING: UNDER TEXAS LAW (CHAPTER 87, CIVIL PRACTICE AND REMEDIES CODE), A FARM ANIMAL PROFESSIONAL IS NOT LIABLE FOR AN INJURY TO OR THE DEATH OF A PARTICIPANT IN FARM ANIMAL ACTIVITIES RESULTING FROM THE INHERENT RISKS OF FARM ANIMAL ACTIVITIES.
READ CAREFULLY BEFORE SIGNING
By signing this agreement, you acknowledge that you have voluntarily chosen to participate (or allow your minor child to participate) in horseback riding and/or activities at Blue Door Equestrian. You understand and accept the inherent risks involved, and you agree to release, waive, indemnify, and hold harmless Blue Door Equestrian, its owners, officers, employees, trainers, contractors, and agents (“Releasees”) from liability.
1. Acknowledgment of Risk
I understand that horseback riding and working around horses is inherently dangerous and involves numerous risks, including but not limited to:
● Falling, being stepped on, kicked, or bitten
● Horses spooking, rearing, bucking, or bolting
● Equipment failure (e.g., saddles, bridles, reins)
● Injuries caused by terrain, weather, or the unpredictable nature of horses
● Risks associated with tack, grooming, or mounting/dismounting I acknowledge that no amount of training or supervision can eliminate all risks associated with these activities.
2. Voluntary Assumption of Risk
I willingly and voluntarily assume all risks of injury, illness, damage, or death related to participation in equestrian activities and the use of any facilities or equipment at Blue Door Equestrian, whether caused by inherent risks, my own actions, the actions of others, or the alleged negligence of Releasees.
3. Release of Liability
I hereby release, discharge, and agree not to sue the Releasees for any claims, liabilities, damages, or losses arising out of or related to:
● My or my child’s participation in equestrian activities
● Any injury, death, or property damage suffered during or related to participation
● The selection, training, or condition of horses or equipment
● The actions or inactions of staff, volunteers, or other participants This release applies even if the claim arises from the alleged negligence of the Releasees.
4. Indemnification and Hold Harmless
I agree to indemnify and hold harmless the Releasees from any claim, damage, liability, or expense (including attorneys’ fees) arising out of my or my child’s participation in equestrian activities, including claims caused by my own negligence. If a lawsuit is filed in violation of this agreement, I agree to pay all attorneys’ fees and costs incurred by the Releasees in defending such an action.
5. Medical Acknowledgment
I understand that no medical personnel or emergency care will be provided by Blue Door Equestrian. I certify that I (or my child) am physically fit to participate and assume full responsibility for any medical expenses resulting from injury.
6. Helmet Policy Acknowledgment
I understand that wearing a properly fitted, ASTM/SEI-certified helmet is required for all mounted activities.
I acknowledge that a protective helmet has been made available to me or my child and that I/we agree to wear it during all riding activities.
7. Texas Law and Severability
This agreement is governed by the laws of the State of Texas. If any part of this agreement is found to be invalid or unenforceable, the remainder shall remain in full force and effect.
8. Agreement for Minors
If the participant is under the age of 18, a parent or legal guardian must sign this release. The undersigned parent/guardian affirms that they are legally authorized to sign on behalf of the minor and agrees to be bound by all terms of this release.
